As of December 31st, 2011 everyone who works on roads traveled by the public (including private property) MUST wear Class 2 or Class 3 ANSI/SEA 107-2004 safety apparel.
This final ruling that was created on December 16th of 2009 for the 2009 MUTCD law. This ruling states all workers within the right of way of any roadway open to public travel are REQUIRED to wear Class 2 or Class 3 ANSI/ISEA 107-2004 compliant high visibility safety apparel by December 31st, 2011.
There has been an increase in injuries and fatalities caused by motor vehicles and construction equipment while working on roadways open to public travel.
The new regulation protects workers in the following areas: towing and recovery, highway construction and maintenance, law enforcement, emergency responders, utility, traffic management professionals and anyone working within the right of way of any roadway open to public travel, including private property.
